Florida cottage food
Baked goods, jams, snacks and more.
Florida's cottage food law lets you make certain foods in your home kitchen and sell them directly to customers. These are
foods that don't need time or temperature control for safety, known as non-TCS foods. Cottage foods must be prepackaged and
labeled, including the statement Made in a cottage food operation that is not subject to Florida's food safety regulations.
Florida also sets an annual gross sales limit for cottage food operations.
Foods that need refrigeration, such as meat, poultry, seafood, dairy, cheesecake, cream or custard fillings, cut fruit, and canned or pickled vegetables, can't be sold as cottage food. If you sell from a permitted or licensed kitchen, you can list the foods your permit covers instead.
Read the details on the Florida Department of Agriculture cottage foods page (opens in a new tab).

Common questions
Everything you need to know.
What types of food can I sell?
It depends on how you sell. Under Florida's cottage food law you can sell foods made in your home kitchen that don't need refrigeration for safety (non-TCS foods), such as breads, cookies, cakes, candies, jams and dry mixes, prepackaged and labeled. If you operate from a permitted or licensed kitchen, you can also list foods your permit covers, such as meals.
See what you can sell for examples. Fudi Eats does not provide legal advice, so check the rules that apply to you.
How do I get paid?
Buyers pay in the app when they order. Payments are processed by Stripe, and your earnings are paid out directly to your bank account through Stripe Connect, on your Stripe payout schedule. You connect your bank account once, while setting up your seller profile.
What fees does Fudi Eats charge?
Fudi Eats keeps a small percentage of each sale, and Stripe charges payment processing. Before you publish a listing, the app shows exactly what you'll receive per sale, so there are no surprises. Current fees are described in our Terms of Service.
Who is responsible for permits and food safety compliance?
You are. Sellers on Fudi Eats are independent businesses and the sellers of record for their food. You're responsible for any permits or licenses you need, labeling, food safety and accurate descriptions, including allergens. Fudi Eats does not inspect kitchens, verify permits or certify food safety.
How do buyers pick up their orders?
You set the pickup location and pickup times for each listing. Before buying, people see only your general area, never your address. Only buyers with a paid order see the exact pickup address. At pickup, you scan the buyer's QR code in the app (or enter their backup code) to confirm the handoff.
Do I need to collect sales tax?
For sales made through Fudi Eats, Fudi Eats collects and remits Florida sales tax as the marketplace provider, so buyers see tax at checkout and you don't collect it separately. Your own income taxes remain your responsibility. This isn't tax advice; ask a tax professional about your situation.
